The Institutional Duty Counsel will work in conjunction with duty counsel at court as part of a team to ensure that remote court appearances are meaningful, effective, and do not lead to a diminished expectation of reasonable bail or resolution for accused persons.This position has been designated as a LAO Workplace Based role and requires physical attendance at Central East Correctional Centre (approximately 1-2 days per week) as well as providing in-person & virtual criminal duty counsel services in the Lindsay Courthouse and some virtual services for the Oshawa duty counsel office.Home Location: Central East Correctional Centre

  • Reviewing and updating bail worksheets, DC notes, and other file materials prepared by DC at court
  • Liaising between the client and DC at court
  • Preparing the client for bail hearings and/or guilty pleas
  • Calling potential sureties, interviewing them for suitability, and arranging for their attendance in court if necessary
  • Making referrals to appropriate organizations for bail or in preparation of a guilty plea
  • Reviewing disclosure and providing summary legal advice to clients
  • Assisting clients in filling out forms (e.g. for video bail or for organizational supports)
  • Performing in-person bail hearings at the Lindsay Courthouse as well as video bail hearings for new arrests in the Amalgamated Bail Court (Lindsay/Cobourg) and the Oshawa Courthouse
  • Assisting with Legal Aid Applications
  • Providing general advice on legal aid processes such as certificate appeals
  • Negotiating with the Crown Bail Vettor with regards to a bail plan or resolution
  • Engaging with both local and non-local stakeholders in ongoing conversation around developing the role of duty counsel assisting from institutions (e.g. facilitate and/or attend regular stakeholder meetings on how to improve remand and bail times locally)
  • Liaising with detention centre staff to facilitate client service
  • File management

Required skills & experience

  • Lawyer in good standing with the Law Society of Ontario
  • Demonstrated experience in representing clients with complex legal issues including conducting bail hearings and guilty pleas
  • Experience conducting bail reviews is an asset
  • Sound knowledge of the Criminal Code of Canada, Canadian Charter of Rights and Freedoms, criminal law procedures, rules of evidence, and case law
  • Practical understanding of the Rules of Professional Conduct
  • Ability to work independently and unsupervised in a fast-paced environment while also demonstrating collaboration and teamwork with colleagues and other stakeholders
  • Proven judgment and analytical ability to determine appropriate legal remedies

  • Assisting unrepresented clients who have been charged with criminal or quasi-criminal matters
  • Representing clients at bail hearings, guilty pleas and remands both in-person and remotely
  • Assessing clients’ needs, including the early identification of vulnerable clients, to facilitate referrals to appropriate services.
  • Providing in-person and remote summary legal advice to clients in or out of custody
  • Assisting colleagues in preparation of bail hearings, guilty pleas and other forms of resolutions
  • When appropriate, representing clients in Crown pre-trial negotiations for purposes of resolution
  • Representing clients in specialty courts including Mental Health, Gladue, Domestic Violence, and Youth Courts as required
  • Ensuring a high quality of legal work in a cost effective manner

Required skills & experience

  • Lawyer in good standing with the Law Society of Ontario
  • Legal knowledge, understanding and skills to be able to represent clients with sensitive legal issues including conducing bails hearings, and guilty pleas.
  • Demonstrated commitment to social justice or public interest work
  • Sound knowledge of the Criminal Code of Canada, Canadian Charter of Rights and Freedoms, criminal law procedures, rules of evidence and case law
  • Practical understanding of the Rules of Professional Conduct
  • Communication, presentation and negotiation skills coupled with strong advocacy skills in the Ontario Court of Justice
  • Proven judgment and analytical ability to determine appropriate legal remedies
  • Knowledge and appreciation of impact of criminal proceedings on immigration, family and other poverty law issues; and the integrated nature of legal issues faced by LAO clients
  • Background/Knowledge/Awareness of the challenges faced when serving vulnerable populations such as racialized communities, First Nations, youth and those experiencing mental health or addiction challenges and/or homelessness
